1. Common statement
1.1 Definition
“Exdreme.com” (in the following “Exdreme”, “we”, “us”, “our”, “platform”) is a limited liability company registered under the laws of Georgia, адрес XXXXXX, Georgia.
“Platform” means the (mobile) website and application owned, controlled, operated, maintained, and/or hosted by Exdreme.com and on which the Service is provided.
“Partner” (in the following “camp provider”, “you”, “your”, “host”, “host provider”) includes accommodation providers (e.g., camps, extreme sports hotels, etc.), recreational providers (e.g., tour companies), transportation providers (e.g., car rentals, cruises, airport transfers, bus tours, extreme sports schools, and private instructors, etc.), travel insurance providers, and all other service providers or products that are available for Reservation on the Platform (B2B or B2C).
“Hospitality unit” (in the following “accommodation”, “camp”) is the hotel, camp, any type of accommodation and/or services included to it which are provided by the platform’s partners, published on the Exdreme.com website and additional channels and become the object of the booking agreement between the client, the partner, and the platform.
“Client” (in the following “client”, “user”) is an individual and/or individuals, an organization and/or organizations that use the platform for personal, non-commercial aims of searching, booking, and connecting the hospitality unit, learning experience and its host.
“Service” means an online purchase, order, purchase, payment (payment processing) or reservation offered by Exdreme.com with respect to Partners products and services on the Platform.
“Booking” means ordering, purchasing, paying for, or reserving a Trip or a lesson.
Our company makes it easier to find and book the perfect vacation absolutely free of charge along with useful tips for trip planning. We assure you that booking active trips and retreats with Exdreme.com is absolutely safe, secure, and efficient.
Exdreme.com aims to build an international platform for the promotion of extreme sports camps and retreats all over the globe. The following statements of Terms & Conditions extend to Exdreme.com and all its subdomains.
1.2. Intellectual property rights
Unless stated otherwise, the software platform and all services and tools connected to it are owned by Exdreme.com and are stated as its intellectual property, as well as the form of extreme sports services, camps, schools, instructors, and retreats (yoga, detox, etc) promotion idea. Thus, the previously mentioned software and its applications follow the conventional rights of intellectual property. It is forbidden to copy, plagiarize, and reproduce the platform components without a two-sided agreement with Exdreme.com and the author’s indication. It is forbidden to attempt the system’s proper operation.
2. For clients
2.1. General
Exdreme.com, (country established in), provides the camps in locations all over the world to individuals and organizations (in the following “client”, “clients”). The following documentation establishes the agreement and the negotiable relationships between Exdreme.com and the clients. The platform is established currently for the personal, non-commercial use of the clients, with no charges.
These terms and conditions, as may be modified from time to time, are applied to all services, directly or through the distributors, provided online, via email, telephone, or any mobile device. By visiting, browsing, or using our (mobile) website or any application on the platform and/or making a reservation, you acknowledge that you have read, understand, and agree to the terms and conditions (including the privacy statement) described below.
2.2. Liabilities
Exdreme.com does not sell, own, and/or dispose of the hotels, accommodation, camps, and their products and/or services provided through the mentioned sharing platform. The hospitality units are owned, presented, and managed by third parties (providers), direct owners, travel agencies, and instructors. The extreme sports and retreats travel providers (partners) are responsible for their accommodation, services, and all agreement and contracts with the clients.
Exdreme.com and all the staff connected for its activities and services realization:
- do not hold responsibilities for any predicted and unpredicted accidents, or health problems of the clients before, during, and/or after the trip;
- do not help responsibilities for any predicted and unpredicted environmental accidents, weather conditions, war, governmental activities, pandemic (including COVID-19) effects and their impact on the trip realization;
- do not hold responsibilities for provided by the partner’s information, offers, visual materials, and content and their correspondents to reality;
- do not hold responsibilities for any predicted and unpredicted changes of the partner’s terms and conditions, offers and programs, stay realization;
- do not hold responsibilities for any causes of trip cancellation both from the side of the client and/or the partner, which are not connected straightly to the activities of Exdreme.com – camps, schools, instructors, online experiences promotion, and booking;
- do not hold responsibilities for the client’s visa rejection, unavailability at the moment of the trip, lack of any required documents, such as medical, trip, and/or social insurance;
- do not hold responsibilities for the actions of the carrier to the trip destination, including tickets unavailability, movement (flight, trip, etc.) cancellation, and/or transfer for the other dates;
- do not hold responsibilities for the matching trip description and the client’s expectations to the reality, neither level of received experience and knowledge if they are expected;
- do not hold responsibilities for mistakes, errors, or inaccuracies on the Edtreme.com website and/or partners’ portals, as well as for technical website damages and errors.
The user of the platform has not to:
- use any tools, supportive technological instruments, virus providers and devices, bots, or any malware software which can provoke damage, errors, and disruptions of Exdreme.com platform work;
- use any manual and/or automated technological tools, software, devices, etc. for Exdreme.com information and content plundering;
- reproduce, copy, or plagiarize any Exdreme.com content, information, or data without our cooperating, official agreement;
- remove, damage, discourage, override platform’s safety measures;
2.3. Price policies for clients
- Clients of the platform do not pay Exdreme.com for the usage of the server, registration on the platform, use of the platform’s content and material for introductory, educational, and/or trip-booking aims.
- The payment for camp services is provided by the client only directly to the partners (representatives of the camp). The price of the services and the fees for reservations (if any) are generated and set up by the partners. Exdreme.com does not hold any responsibilities for and does not influence on trip price, reservation fees setting up, and their exchange between the client and the partner.
- According to the possible unpredicted and predicted currency changes, the actual fees and trip prices can differ from the preliminary prices.
- For the reservation, the client has to pay the camp 30% of deposit fees from the whole price of the trip, or if it is stated by the client, the percentage of cost cover may increase. The minimum stated – 30% or any other percentage stated by the partner deposit fees are not refundable.
3. COVID-19 updates
According to the unstable and unpredictable worldwide situation concerning COVID-19, there are necessary requirements for 3 sides of the communication – for the client, the partner, and the platform. We ask you to check the updates concerning the terms and conditions of the COVID-19 updates as the situation changes regularly.
- The host provider is liable for regulating the information about the COVID-19 situation and requirements about it in case of the concrete accommodation, published on Exdreme.com;
- The host provider is liable for book cancelations and rejections connected to the COVID-19 updates and their regulation;
- The host provider is liable for accommodation full preparation in accordance to the common safe measures (keeping clean, regular sanitization, giving guests the possibility to keep social distance, medical support, guests checking measures);
- The client holds all requirements for following the safe measures (COVID-19 checking before, during, after trip, following safety measures and instruction by the host);
- In the case the client books the accommodation at the moment the borders of his/her state of living or the borders of the host country are closed, the client takes all liabilities for the risks concerning the visa, transport tickets, booking regulation processes. As well, as he/she is responsible for cancelation of the booking caused by the positive COVID-19 test or any active COVID-19 symptoms before and/or during the trip;
- In the case the host provider publishes and accepts bookings for the spot which is currently/for the moment of booking is forbidden for tourists/visitors because of the COVID-19, the host provider is reliable for each booking cancelation/transferring;
- In the unpredictable cancelation connected with COVID-19, the host is obligated to regularize the situation concerning the provided to the client in advance information. On the contrary, in the situation of the lack of such information at the moment of providing a booking agreement, the partner is obligated to proffer the client the rebooking option or refund the paid by the client fees and reservation charges;
- The client takes all responsibilities for the attentive checking, acceptance, and following of the COVID-19 requirements, established by the partners before the booking of the hospitality unit.
